5.46 - Due Process and Employee Grievance

Purpose

The College is committed to ensuring fairness, equity, and transparency in all administrative and disciplinary matters.

The purpose of this policy is:

  1. To provide due process protection in disciplinary and administrative proceedings.
  2. To secure, at the lowest possible level, an equitable solution to complaints arising from alleged violations of official College policies and/or administrative procedures affecting working conditions.
  3. To ensure that no employee or student is penalized for raising a concern in a reasonable, professional manner, or for utilizing established grievance procedures.
Disputes alleging unlawful discrimination, harassment, or retaliation under applicable federal or state law cannot be resolved through this grievance procedure. They shall instead be addressed in accordance with the College’s nondiscrimination policies.

Scope

This policy applies to:
  • All College employees (unless covered by a separate negotiated agreement)
  • Administrators
  • Supervisory personnel
  • Staff members
  • Student disciplinary matters (where applicable procedural protections apply)

Professional employees covered under a Master Contract shall be governed by the grievance procedures outlined in that agreement.

Guiding Principles

All proceedings under this policy shall adhere to the following principles:
  • Fair notice of allegations
  • Opportunity to respond
  • Impartial review
  • Timely resolution
  • Proportional outcomes
  • Protection from retaliation
  • Confidentiality consistent with law

Non-Retaliation

No reprisals of any kind shall be taken against a grievant by any member or representative of the Administration or the Board of Trustees because of the filing of a grievance. No employee will be penalized, formally or informally, for voicing a complaint in a reasonable, professional manner, or for using the grievance procedure.

Initiation of Grievance

The grievance process is initiated when the employee files a Grievance and Disposition Form, located in Human Resources.

The completed form shall be filed with the Chief Human Resources Officer (CHRO) or their designee.

The CHRO shall:

  • Notify all parties involved in writing
  • Notify supervisors of the individuals involved
  • Ensure procedural timelines are observed
